Terms of service
These terms apply when you ask Harmony Future Holdings Limited, trading as Flagship Bids ("we"), to prepare a response to a public tender. They are for businesses only. We do not supply consumers.
What we do, and what is yours to do
What this is. An information and document-preparation product, supplied as a service: we prepare bid material from your documents. We are not a law firm, and nothing we supply is legal, tax or regulatory advice.
We do not represent you. We do not act as your agent. We do not deal with the buyer, a portal or any authority on your behalf.
What is yours to do. You are responsible for the accuracy of the information and documents you give us; for reading what we produce and changing it where needed; for signing any declarations; and for submitting the bid and using it yourself.
No guarantees. We do not guarantee any legal, tax, regulatory or commercial outcome, including whether a bid is shortlisted or wins.
When to get a professional instead. If a tender raises a legal dispute, a challenge to the buyer's decision or a question about your legal obligations, obtain independent professional advice.
Keeping it current. We update our templates and checklists when the law, procurement rules or buyer requirements change.
1. The service
For each tender we agree in writing (an email is enough) we prepare: a compliance matrix of the tender's requirements, a draft answer to each quality question, and a list of evidence still missing. We work only from the tender pack and the documents and information you give us.
2. What you do
You download and send us the tender pack, send us your supporting documents, and answer our questions. You review the response, decide what is submitted, sign any declarations and submit it yourself. You are responsible for the accuracy of what you submit and for meeting the buyer's deadline.
3. The 3 working days and "on time or you pay nothing"
The 3 working days start when we confirm by email that we have the tender pack, your documents and the answers from the call. The tender must close at least 5 working days after that start. Working days are Monday to Friday, excluding public holidays in Ireland. If we hand over after the end of the third working day, no fee is payable for that tender. No other compensation is payable for lateness.
4. Price and payment
The price is the fixed fee agreed for that tender: €1,750 for an Irish tender or £1,500 for a UK tender, unless a different figure was agreed in writing for a large tender before work started. Prices exclude VAT, which is added where it applies. We invoice after handover, and payment is due within 14 days. There is no success fee.
5. No promise of success
We do not promise that any bid will be shortlisted or win. The outcome depends on the buyer's evaluation, your price, your track record and the other bidders.
6. Your documents and confidentiality
We keep your documents and the tender pack confidential and use them only to prepare your response. Where your documents contain personal data, such as staff CVs, we process it only on your instructions and as described in our privacy notice. We delete your documents 30 days after handover unless you ask us in writing to keep them.
7. Ownership
Once the invoice is paid, or if no fee is payable because we were late, the response we prepare for you is yours to use, change and reuse.
8. Liability
Our total liability for any tender is limited to the fee paid for that tender. We are not liable for loss of a contract, profit or opportunity. Nothing in these terms limits liability that cannot be limited by law.
9. What this service is not
We prepare bid material for you to review and submit. This is not legal advice, and we do not advise on or act in a procurement challenge or dispute with a buyer.
10. Complaints
If you are unhappy with the service, email hello@flagshipbids.com with the subject "Complaint". We acknowledge every complaint within 2 working days and reply in full within 10 working days.
11. Law
These terms are governed by the law of Ireland, and the Irish courts have jurisdiction.
